General Terms and Conditions

These General Terms and Conditions (GTC) apply to all orders placed through the online shop of Farmacia del Parco (hereinafter "pharmacy"). By placing an order, the customer accepts these GTC.

The presentation of products in the online shop does not constitute a binding offer but an invitation to order (invitatio ad offerendum). The contract is only concluded when the pharmacy confirms the order.

The pharmacy reserves the right to decline orders, particularly in cases of suspected misuse, unavailability, or regulatory restrictions under the Therapeutic Products Act (TPA).

Only non-prescription products (categories D and E pursuant to Art. 23ff TPA) are offered in the online shop. Prescription medications are excluded from online sales.

All prices are stated in Swiss Francs (CHF) and include VAT. Payment is processed through the payment service provider Payrexx AG via TWINT, credit card (Visa, Mastercard) or other payment methods. Payment is completed before delivery or preparation for pickup.

The customer may choose from the following options:

• Pharmacy pickup: Free of charge. The order is ready in approx. 10 minutes.
• Postal delivery: CHF 3.50. Delivery typically within 1–3 business days within Switzerland.

Stated delivery times are non-binding estimates. The pharmacy is not liable for delays caused by the courier service.

Swiss law does not provide a statutory right of withdrawal for online purchases (cf. Art. 40a ff. CO). However, the pharmacy voluntarily grants a 14-day return right from receipt of goods, provided that:

• products are unopened and in their original packaging;
• products are not excluded from return for hygiene reasons;
• return shipping is free (return costs are covered by the pharmacy).

Refunds are issued via the original payment method.

The pharmacy warrants product quality in accordance with applicable pharmaceutical standards. Liability is limited to the purchase price of the affected products. Further claims for damages are excluded to the extent permitted by law.

Personal data is processed in accordance with the Swiss Federal Act on Data Protection (nFADP) and the pharmacy's privacy policy. For more information, see our Privacy Policy.

Swiss law applies exclusively, excluding conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes is Lugano TI, to the extent permitted by law.

The pharmacy reserves the right to amend these GTC at any time. The GTC in effect at the time of the order shall apply.
